Burden of Proof or Evidential Burden
I am not a lawyer. The statements below are more of clarificatory in nature, your honor.
Here in the States, government agencies requiring documents asked for original to be presented while they accept photocopies for their records. Kagaya ng birth certificate, death certificate and certificate of naturalization. They won't require you to submit the original copies lest they may be misplaced so when the time comes that they are processing your papers, they would ask you to present the original. The officer personally checks the photocopy from the original to find out if it is a faithful reproduction of the original. At the Social Security office, they asked for my original birth certificate when I changed my immigration status but they returned it via snail mail in a self-stamped envelop.
So muntik ng makatakbo yong ilong (runny nose) ko nang ideclare ni Jinggoy Estrada na original yong documents galing sa bangko, eh photocopy ngayon eh at wala ang original. Toink, toink toink.
Anong basehan niya?
Itinatanong ko sa sarili ko (na hindi sumasagot) kung anong patutunguhan ng kaniyang " family tree question" sa branch manager. Kung gusto niyang ipahiwatig na ang manager ang source ng "fake documents", is he insinuating that the source discredited the evidence that she " could have possibly leaked because of some family ties ? Why? Bakit pa i-lileak kung sasabihing fake rin naman. Am I missing something? Sabi nga Kungfushoes, the more you confused, the more people will get confused. Ahek, Silly.
Shouldn't the prosecution lawyers prove that the documents are not fake as claimed by the branch manager?
Why is it the impeachment court thru the senator judges is the one proving otherwise. Nasaan ang burden of proof or evidential burden ba yan? Nasaan ba ang ating lawyer expert na si biyay. Baka makita ko nasa GMA7 na rin siya na may nakasabit na pashamina shawls at panay ang pacute. (frankly, I am also learning from her).
Hampas forehead, ikot ng mata, at biglang sigaw ng Tseh. Wala akong natutuhan sa Day 18.
Discrepancies
Kahit naman ako, magwawala katulad ni Juan Ponce Enrile kung sinasabi mong may discrepancies pagkatapos di ka man lang gumawa ng notes kung ano yon. Nadagdagan pa ng sampung taon ang edad ni JPE sa kunsomisyon.
Auditors are trained to look for discrepancies and reports are designed in such a way that these discrepancies are highlighted and easily discerned by lay people so that reports are arranged by columns with labels, SHOULD HAVE BEEN; WAS RECORDED/PRINTED and DISCREPANCIES NOTED.
Kahit hindi auditor, ang presentation na simple lang pero madaling maintindihan ay makakatulong to send the message across.

sa totoo lang, ayoko na manood ng impeachment trial kasi nabobo lang ako. di ko kasi maintindihan ang point ng mga prosecutors at ng prosecutor-judges.
o siguro, sobrang talino lang nila at marami sa aming lawyers e nahilo na. Ngayon ko lang nalaman na mas magpe-prevail pala dapat ang US jurisprudence sa mga batas natin. Salamat Cayetano siblings!

That should go to SALN 2011 with the cut off date of 12/31/12 to be submitted later than 4/30/12.
